FAQ
Do these warranty deed templates include language for seller disclaimers or ‘as-is’ clauses?
Some templates, particularly the general warranty deeds, include standard seller warranties about title clearances. However, to add disclaimers like ‘as-is’ or exclude certain risks, you’ll need to manually edit the language or consult a local attorney—these forms provide the framework, not a substitute for legal advice. Special warranty deeds often omit some of these guarantees.
Can I use these forms if the property has a homeowners association (HOA) or shared driveway responsibilities?
The templates don’t include HOA-specific sections, but most warranty deeds leave space for additional clauses. You’ll need to manually add language referencing HOA rules or shared easements in the ‘Additional Provisions’ field. Always check your HOA’s requirements first, as some require separate disclosures.
What if the seller is a trust or LLC instead of an individual?
These templates assume individual sellers, but you can replace names with the trust or LLC name in the grantor section. For LLCs, include the entity’s registered agent name and state in the ‘Grantor’ line. If the trust is revocable or irrevocable, note that in the ‘Additional Provisions’—but consult a lawyer to ensure compliance with your state’s trust laws.
