These Terms of Service ("Terms") govern your access to and use of TemplateSpark (the "Service"). By creating an account, making a purchase, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Eligibility & Accounts

You must be at least 16 years old to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use. You agree to provide accurate, current, and complete information.

2. The Service

TemplateSpark provides a marketplace for premium website templates, printables, and related digital resources. We may add, modify, or discontinue features at any time. We do not guarantee that any specific template will remain available indefinitely.

3. Subscriptions & Billing

• Paid plans are billed in advance on a recurring basis (monthly or yearly) until cancelled.
• Free trials, where offered, automatically convert to a paid plan unless cancelled before the trial ends.
• Payments are processed securely by Stripe. By subscribing, you authorize recurring charges.
• You can cancel at any time from your account; access continues until the end of the current billing period.
• Prices may change with reasonable advance notice; changes do not affect the current paid period.

4. Licenses to Downloaded Content

Your use of any template or resource downloaded from the Service is governed by our License & Refund Policy, which is incorporated into these Terms by reference. Please review it carefully before purchasing or downloading.

5. Acceptable Use

You agree not to:

• Resell, redistribute, or sublicense templates as-is or as stand-alone files.
• Reverse engineer, scrape, or attempt to gain unauthorized access to the Service.
• Upload malicious code or use the Service to infringe the rights of others.
• Misrepresent your identity or use the Service for unlawful purposes.

6. Intellectual Property

The Service, including its design, branding, code, and original content, is owned by TemplateSpark and protected by intellectual property laws. Except for the rights expressly granted under the License Policy, no rights are transferred to you.

7. User Content

If you submit content (such as comments or reviews), you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with the Service. You are responsible for ensuring you have the rights to any content you submit.

8. Disclaimers

The Service and all content are provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

9. Limitation of Liability

To the maximum extent permitted by law, TemplateSpark will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Service. Our total liability for any claim will not exceed the amount you paid us in the twelve months preceding the claim.

10. Termination

We may suspend or terminate your access to the Service if you violate these Terms. You may stop using the Service at any time. Provisions that by their nature should survive termination will survive.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use after changes take effect constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the applicable laws of the jurisdiction in which TemplateSpark operates, without regard to conflict-of-law principles.
